In Brookville, Ohio you are not required to license or contain your cat. Is it legal for a neighbor to trap y?
My neighbor had 2 stray cats come to her house. She has been feeding them. One of them had a liter of kittens. The neighbor lady on the other side is elderly and bored and she says these 8 week old kittens are damaging her property. Nonsense!! However, she is trying to trap the kittens in animal traps and take them to the animal shelter. The police department says it isn't legal, however if you call them they will give you a trap?!!! Please help!!
It is perfectly legal to trap ANY animal that comes onto your private property, so long as you use a humane trap.
I'd also note that, even though there is no legal obligation to contain your cats, you are still civilly liable for any damage they cause. If your friends cats dig up her neighbors roses to bury their poop, for example, then she can be successfully sued for the cost of replacement roses.
A lady in my home town recently sued her neighbor after the neighbors large aggressive tomcat attacked her Chihuahua on her porch. She won several hundred dollars in vets fees.
